The Military Divorce Process

In over 12 years of practicing law, I have handled numerous military divorce cases involving military personnel and military spouses stationed all over the world, including Afghanistan, Germany, Iraq, Italy, Japan, and South Korea.

It is possible to handle a military divorce much like a traditional divorce. Instead of face-to-face meetings, much of the correspondence is done over the phone or through e-mails. Documents are sent through Fed-Ex. For your convenience, I will make my services as accessible as possible.

I help military personnel resolve all issues related to divorce involving child custody, child support, spousal maintenance or alimony, property division. I also handle motions for modification of custody or support after a divorce.

Soldiers and Sailors Relief Act and Divorce

If you are serving in the military, it is important to know how you have certain protections against non-military related legal and financial obligations. Under the Soldiers and Sailors Relief Act, deployed military members have rights and protections against certain legal and financial matters. The law provides that service members do not have to respond to civil actions, including those seeking divorce, while on active duty. The purpose of the law is to allow American soldiers, sailors, marines and air force members to concentrate on defending our country, instead of worrying about court proceedings.

As an active duty service member, however, you can waive the protections of the Soldiers and Sailors Relief Act and consent to a divorce being completed while you are deployed.
